Terms of Service

Welcome to Buchman Baseball Academy LLC (“BBA,” “we,” “our,” or “us”). These Terms of Service govern the use of buchmanbaseball.com, customer accounts, bookings, purchases, programs, and BBA facilities.

By creating an account, making a booking or purchase, registering a participant, or using BBA’s services, you agree to these Terms of Service, BBA’s Privacy Policy, applicable waivers, posted Facility Rules, and any service-specific terms provided during registration or checkout.

1. Eligibility and Authority

Bookings, purchases, and participant registrations must be completed by someone who is at least 18 years old.
A parent or legal guardian must register participants under 18 unless another authorized adult is permitted to do so.
By registering a minor, you confirm that you are authorized to provide the participant’s information and agree to these Terms on the participant’s behalf.
You are responsible for providing complete and accurate registration, contact, emergency, medical, and payment information.

2. Services and Bookings

BBA services may include private lessons, camps, clinics, parties, lane rentals, facility rentals, team training, HitTrax sessions, and other baseball- or softball-related activities.
Bookings may be made through our website or directly with BBA staff.
All services are subject to availability.
Prices, coaches, schedules, facility availability, and program details may change before a booking is completed.
BBA may correct pricing, scheduling, or description errors and may cancel or modify a booking affected by an error.
A booking is not confirmed until the required payment or deposit has been received.
Additional terms displayed during checkout or included in a signed rental agreement are incorporated into these Terms. If a signed agreement conflicts with these general Terms, the signed agreement will control for that booking.

3. Payments, Cancellations, Refunds, and Credits

Payment is required when a booking is made unless BBA provides a different payment schedule in writing.

Private Lessons, Lane Rentals, and Single-Session Facility Rentals

Cancellations made at least 24 hours before the scheduled start time will receive a credit toward a future BBA service.
Cancellations made fewer than 24 hours before the scheduled start time and no-shows will not receive a refund or credit.
No cash refunds will be issued for private lessons, lane rentals, or single-session facility rentals.

Winter Team and Seasonal Facility Rentals

A 20% deposit is required to reserve the team’s dates and times. The deposit will be applied toward the total rental cost.
The remaining 80% may be paid at any time but must be paid in full no later than the team’s first scheduled practice day.
Cancellations made at least 60 days before the team’s first scheduled practice will receive a full refund.
Cancellations made fewer than 60 days before the team’s first scheduled practice will forfeit the 20% deposit. Any amount paid above the deposit will be refunded, and no additional balance will be owed.
Once the team’s first practice has taken place, the full contracted rental amount is due and all payments are nonrefundable.
Practices missed or canceled by the team after rentals begin will not receive a refund, credit, or makeup date.

Summer Camp

Summer camp registrations are nonrefundable.
A registration may be canceled at any time before the participant’s first scheduled day of camp, but a BBA credit will be issued instead of a refund.
Once the participant’s first scheduled day of camp has begun, no refund or credit will be issued for missed, canceled, or unused camp days or weeks.

Clinics and Special Programs

Clinic and special-program registrations are nonrefundable.
If a registration is canceled before the clinic or program begins, a BBA credit will be issued.
Once the clinic or program has begun, or if the participant does not attend, no refund or credit will be issued.

Credits

Credits are valid for 12 months from the date they are issued.
Credits may be applied toward eligible BBA programs or services but cannot be redeemed for cash.

Cancellations by BBA

If BBA must cancel a lesson, rental, clinic, camp session, or other service because of weather, a facility issue, staff availability, or another unforeseen circumstance, BBA will work with the customer to reschedule or arrange a makeup date based on availability.
If a makeup date cannot be arranged, BBA may issue a credit for the canceled service.

4. Waivers and Assumption of Risk

Baseball, softball, athletic training, facility use, and related activities involve inherent risks, including the possibility of serious injury.
All participants must have a completed BBA waiver before participating.
A parent or legal guardian must complete the waiver for a participant under 18.
By participating, players and their parents or guardians acknowledge and accept the risks associated with athletic activities.
The separate BBA waiver is incorporated into these Terms and remains fully applicable.

5. Facility Rules, Supervision, and Conduct

All participants, parents, coaches, renters, and guests must follow BBA’s posted Facility Rules and staff instructions.
Participants must use equipment and designated training areas safely and appropriately.
Outside coaching, instruction, or use of BBA equipment is not permitted without prior approval.
BBA may remove anyone whose conduct is unsafe, disruptive, abusive, disrespectful, or in violation of facility rules. Removal for misconduct will not result in a refund or credit.
Players under 18 using the facility without a BBA instructor must be supervised by a responsible adult or team coach.

6. Property Damage

Damaged equipment or facility damage must be reported to BBA immediately.
The customer, renter, or team responsible for the booking is responsible for the cost of repairing or replacing damage caused by its players, coaches, parents, or guests.
BBA may charge the responsible customer or renter for reasonable repair, replacement, or cleanup costs resulting from misuse, negligence, or a violation of facility rules.

7. Customer Accounts

Customers are responsible for maintaining the confidentiality of their account information and password.
Customers are responsible for activity conducted through their accounts.
BBA must be notified promptly if an account is used without authorization.
BBA may suspend or close an account for nonpayment, fraud, misuse, repeated cancellations, unsafe conduct, or violations of these Terms.

8. HitTrax and Third-Party Services

BBA may provide access to third-party services and technology, including Stripe and HitTrax. Use of those services may be subject to the provider’s separate terms and privacy policies.

BBA is not responsible for outages, interruptions, account issues, or data practices controlled solely by a third-party provider.

9. Intellectual Property

All website content, logos, business names, text, graphics, photographs, videos, training materials, and other BBA materials are owned by or licensed to Buchman Baseball Academy LLC.

BBA content may not be copied, reproduced, distributed, modified, sold, or used for commercial purposes without written permission.

10. Privacy

BBA collects and uses personal information as described in its Privacy Policy.

The Privacy Policy explains how BBA handles registration information, participant information, payments, customer accounts, cookies, analytics, HitTrax information, and information concerning minors.

11. No Guarantee of Results

BBA does not guarantee any particular athletic, performance, recruiting, team, or competitive result. Player development depends on many factors, including attendance, effort, physical ability, health, practice, and participation.

12. Limitation of Liability

To the fullest extent permitted by law, BBA will not be responsible for indirect, incidental, special, or consequential losses arising from the use of its website, services, programs, or facility.

Nothing in these Terms limits any right or responsibility that cannot legally be limited under applicable law.

13. Changes to These Terms

BBA may update these Terms when its services, policies, or legal obligations change. Revised Terms will be posted on this page with an updated date.

Changes will apply to future bookings after the revised Terms are posted. A completed booking will generally remain subject to the terms in effect when the booking was made, unless the customer agrees otherwise or a change is required by law.

14. Governing Law

These Terms are governed by the laws of the State of New Jersey. Any legal proceeding relating to these Terms or BBA’s services must be brought in a court with proper jurisdiction in New Jersey.

If any part of these Terms is found unenforceable, the remaining provisions will continue to apply.
